DIGIVESTASI - The Supreme Court of Indonesia has granted the petition filed by the Chairman of the Garuda Party, Ahmad Ridha Sabana, regarding the interpretation of the age requirement for regional head candidates. This decision is documented in Decision Number 23 P/HUM/2024, made by the panel of judges on Wednesday, May 29, 2024.
In its ruling, the Supreme Court altered the age requirement for candidates for governor and deputy governor from having to be 30 years old at the time of the candidate pair’s determination to being 30 years old at the time of inauguration.
The Supreme Court also ordered the General Elections Commission of the Republic of Indonesia (KPU) to revoke Article 4 paragraph (1) letter d of KPU Regulation Number 9 of 2020, which amended KPU Regulation Number 3 of 2017 for the fourth time.
In its considerations, the Supreme Court stated that Article 4 paragraph (1) letter d of KPU Regulation Number 9 of 2020 contradicts higher legislation, specifically Law Number 10 of 2016.
"And it does not have binding legal force as long as it is not interpreted as being at least 30 years old for candidates for governor and deputy governor and 25 years old for candidates for regent and deputy regent or mayor and deputy mayor, counted from the inauguration of the elected candidate pair," stated the decision, quoted on Thursday, May 30, 2024.
This means that a person can run for governor and deputy governor if they are at least 30 years old, and for regent and deputy regent or mayor and deputy mayor if they are at least 25 years old at the time of inauguration, not at the time of being determined as a candidate pair for regional head.
Ridha filed the judicial review regarding the age requirement for regional heads with the Supreme Court on April 23, 2024. The application was distributed on May 27, 2024, and decided three days later. The session was chaired by presiding judge Yulius, with two members, Cerah Bangun and Yodi Martono Wahyunadi.
